Terms of Sale

Aim:

These Terms and Conditions aim to define the contractual relationship between PERCKO UK LTD, 14-16 Dowgate Hill, Office G07, London, EC4R 2SU, United Kingdom, Company Number 13101764,  and the buyer, and the terms and conditions applicable to any purchase made via the PERCKO UK LTD shopping website www.percko.com/gbp (also advertised as percko.co.uk). The Terms and Conditions which follow have been created to inform potential customers of the terms and conditions and processes for purchases, sales and the delivery of all products offered by the company on its website. These Terms and Conditions also set out the rights and obligations that sellers and consumers must comply with in order that transactions take place as efficiently as possible.
All orders placed via the www.percko.com/gbp website imply that the buyer has read and accepted the Terms and Conditions.

1. Description of the goods and services offered:

The products and services offered are those which appear in the catalogue published on the seller's website.

Each product is accompanied by non-contractual description and photographs. Photographs and descriptions of the products in the catalogue are as true and accurate as possible, but cannot under any circumstances be supposed to be exactly like the product offered, in particular with regards to colour. Therefore, PERCKO UK LTD cannot be held liable in the event of error or omission in any of the text, photographs or images relating to the product, nor in the event of modification of the product characteristics by the supplier.

2. Prices:

2.1 Price of the products

Product prices are shown in pound sterling inclusive of all taxes, i.e. including UK VAT and any other additional or related taxes, and exclude shipping costs and order delivery charges for orders to be delivered within the United Kingdom.

For all products shipped outside the United Kingdom, the invoice price will automatically be calculated excluding taxes. Customs duties and/or other local taxes or import duties or state taxes will be requested by local administrative bodies. These duties and costs are not the responsibility of PERCKO UK LTD. They shall be borne by the buyer and be their responsibility, both in terms of declaration and payment to the authorities and/or relevant agencies in the country in question.

The products remain the property of PERCKO UK LTD until full payment of the price.

Any individual order from a trade customer, works council or other organisation will be processed after contact has been made via email or telephone.

2.2 BLACK FRIDAY offer

You can find full details of the BLACK FRIDAY offer running from 7th November until 5th December 2022 on the percko.com/gbp website. This offer will automatically be applied to the shopping cart when you add any products included in the offer.

The promotion does not apply to e-gift cards or Loop. If you add this product to your basket, choose at least one other product to benefit from the Summer Sale offer.

The offer is detailed here:

- For one PERCKO top purchased (excluding e-gift cards or Loop), a £15 discount will automatically be applied to your basket.
- For two PERCKO tops purchased (excluding e-gift cards or Loop), a £50 discount will automatically be applied to your basket.
- For three or more PERCKO tops purchased (excluding e-gift cards and Loop), a £25 discount is automatically applied to each PERCKO top.

Any promotional code from a partner (coupon site or other) cannot be combined with the current offer on the website.

2.3 £5 off the first order

When you sign up to receive PERCKO Marketing Newsletter, you will be emailed a voucher code which you can use to redeem £5 off your first order within 10 days. The offer cannot be used in conjunction with partners offers (e.g cashback). PERCKO UK LTD reserves the right to make any changes or withdraw the offer at any time.

This voucher code does not apply to e-gift cards or Loop.

2.4 E-gift card terms and conditions

For the purchaser: You cannot benefit from the current offers on the website for the purchase of a gift card.

For the beneficiary: You can benefit from the current discount as long as this product is part of the promotion. This notably excludes the purchase of two e-gift cards, or an e-gift card and another PERCKO product.

3. Orders:

3.1 Information on orders

The buyer acknowledges that they have the legal capacity to make an order and that they are over 18 years of age.

Electronic confirmation of the order constitutes acceptance of these Terms and Conditions by the buyer, and acknowledgement that they have been read and understood, and that the buyer waives the right to claim their own terms of purchase or other conditions. The agreement is then considered fixed and final.

All data supplied during the purchase and the saved confirmation is considered proof of transaction. This confirmation will serve as proof of signature and acknowledgement of the transaction by the buyer.

The seller will send an email confirmation of the registered order.

The customer can follow the progress of their order on the website by clicking on ‘My Account’.

3.2 Use of e-gift card when placing orders

If you want to send a PERCKO gift to a close one but you are not sure which product, colour and/or size will suit them, you can send them an e-gift card worth £99. Your loved one will be able to take the time to choose their PERCKO product as they have one year to use their e-gift card.

After purchasing the e-gift card, you will receive the e-gift card by email within minutes of validating your order, this can be printed or directly transferred by email to the beneficiary.

The beneficiary will simply have to go to percko.com, choose the desired product(s), then add the e-gift card code (with capital letters and spaces) on the Shopping Cart page in the field "Discount or voucher code" below the order summary. Once the order is placed, the package will be delivered to the given address.

The e-gift card can be used in one or more transactions.

You can only use one e-gift card per order to contribute to the payment of the order.

In the event that the e-gift card does not cover the full amount of your purchases, you may complete your payment by another method.

3.3 You haven’t received your e-gift card in your mailbox yet and you are wondering if this is normal.

Immediately after completing your purchase, you should receive an automated confirmation email for your order as well as one separate email per ordered gift card. We recommend first checking your spam folder. If there is nothing there, please do not hesitate to contact [email protected] with your order number.

3.4 What are the withdrawal rights of the E-gift card?

In the case of an e-gift card purchased on the site :

- For the purchaser: The e-gift card cannot be exchanged or refunded in any form whatsoever, even partially, particularly in the event of loss, theft or expiry.

- For the beneficiary: If an order is paid for in full by an e-gift card and the product is not suitable, the beneficiary of the e-gift card may benefit from an exchange.

If an order is paid for with an e-gift card and another means of payment, only products of equivalent value to the amount of the payment are refundable; otherwise all products in the order may be exchanged. In the case of an exchange, the cost of return will be charged to the beneficiary.

4. Payment Terms:

Payment for products and any postage charges related to the order are payable in full at the time of ordering by the customer to confirm their acceptance of these charges.

For UK orders, payment is expressed in pound sterling and inclusive of VAT.

On the request of the buyer, a paper or electronic invoice highlighting payable VAT will be issued.

For orders outside the United Kingdom, the buyer is responsible for the payment of VAT and taxes applicable in the country if it is not automatically requested by the country’s customs services.

PERCKO UK LTD cannot be held responsible for the non-payment of this tax or any tax relating to a shipment outside the United Kingdom between their customers and their country’s customs services.

Customers can make payments using:

– Credit card or Debit Card (Visa, MasterCard, American Express)

– PayPal

– Klarna

Order payment may be reversed at any time until 120 days after the date the order was placed. As such, PERCKO UK LTD reserves the right, at its sole discretion, not to ship a package where the payment, the IP address or the delivery address appears suspicious or dangerous for itself or for a third party.

PERCKO UK LTD will then not be responsible for the payment of damages or compensation of any kind since this is a matter that affects the safety of their customers, suppliers and service providers.

4.1 Klarna

5. Delivery:

5.1 Delivery times and availability:

The products offered on the website are subject to available stock.

If for any reason, the seller is unable to deliver the order to the buyer, the seller shall contact the customer and give them the option to change, modify or cancel their order.

5.2 Delivery charges:

The prices indicated on the Website are VAT inclusive for deliveries in the United Kingdom. For delivery addresses outside of the United Kingdom, the indicated prices exclude tax. The buyer shall then be responsible to pay the country’s taxes upon receipt of the products.

The prices indicated on the Website do not include delivery costs. Free shipping worldwide. (excluding customs extra fees)

5.3 Carrier:

The buyer assumes all risks from the moment the products have left the seller’s or their carrier’s premises and until the customer returns the product to the seller.

The seller shall ensure that products are properly protected for transport. If, despite this protection, ordered products are damaged during transport, the buyer may either refuse to accept the delivery of damaged goods or make dated and signed handwritten reservations on the delivery note or at the post office depending on chosen carrier.

The buyer should also contact PERCKO within 24 hours and follow the website returns request procedure which can be accessed from ‘Your Account’, ‘View Previous Orders’ then ‘Order Detail’ indicating the product concerned and the reason for the return. After verification, the seller shall send the buyer a returns number and the procedure to follow by email.

The product must be returned by the customer in its original packaging intact and sealed. A photocopy of the invoice must be attached to the product and the returns number marked on the carrier packaging.

The seller shall deliver the replacement product after return of the damaged product at their own expense and subject to available stock. The return cost for the damaged product will be refunded to the customer on receipt of proof of payment.

The seller will not accept returned goods if a returns number has not been sent to the buyer.

5.4 Product missing on delivery or delivery does not conform to the order:

If the customer finds that a product is missing upon delivery by the carrier, they must contact the seller within 48 working hours following delivery and provide the order number. The seller will then deliver the missing product as soon as possible without additional postage charges, or will carry out a product exchange if the delivery does not conform to the order.

To make an exchange, the customer must contact the seller:

– for missing products, by email to [email protected], with their order number

– for delivered products which do not conform to the order, by email to [email protected], with their order number the customer may then request a returns number indicating the product they wish to return and the reason for the return. After verification, the seller shall send the buyer a returns number and the procedure to follow by email. The product must be returned by the customer in its original packaging intact and sealed. A photocopy of the invoice must be attached to the product and the returns number marked on the carrier packaging. The cost to return the damaged product will be refunded on receipt of proof of payment and the product that was not delivered in accordance with the order will be delivered without additional postage charges to the customer.

6. LEGAL COOLING-OFF PERIOD

6.1 The statutory minimum cooling-off period

The statutory minimum for a cooling-off period is 14 days from the day of receipt of the parcel containing the ordered products. Within this period, the buyers can change their mind without having to give a reason for the decision. However, for convenience, we extended the cooling-off period to 100 days

In the case of an e-gift card purchased on the website:
- For the Purchaser: The e-gift card cannot be exchanged, returned or refunded, neither in full nor partially. PERCKO UK LTD cannot accept liability for lost, stolen or expired e-gift cards.
- For the Recipient of the e-gift card: If an order is fully paid with an e-gift card and the product is not suitable, the Recipient is entitled to an exchange. If an order is paid with an e-gift card and another payment method, only products with a value equivalent to the one paid with the other payment method can be refunded. In addition, all the products from the order can be exchanged. In the case of an exchange, the return postage is payable by the Recipient.

6.2 Consequences of legal cooling-off period

If the cooling-off period applies and the Purchaser respects the conditions set out in this article with regard to the time-frame and return procedure, the Purchaser will be refunded for the returned products and the Order delivery costs.

The Buyer will be refunded for the unit price of the returned product. If the Buyer has benefited from a multibuy discount  and only returns some of the ordered items, he will be refunded the difference between the total paid and the unit price without promotion.

6.3 Costs

PERCKO UK LTD will not pay the cost of returning the Products.

6.4 How to cancel the purchase during the legal cooling-off period

The Purchaser or, where applicable, the recipient of the Order, must inform PERCKO UK LTD of their wish to benefit from the cooling-off period by contacting the PERCKO Customer Service within 100 days. The buyers have to contact PERCKO UK LTD by email to the following address: [email protected].

The Purchaser will be refunded for the amount of the Order and the delivery costs effectively paid at the time of delivery. However, for orders delivered outside the United Kingdom and for which customs duties have been invoiced to the Purchaser, PERCKO UK LTD will not refund the customs duties.

6.5 General provisions applicable to all types of returns

The products must be returned to PERCKO UK LTD in the original packaging, in a saleable condition, at the latest 14 (fourteen days) after the date of receipt thereof.

7. Cancellation:

The customer may request the cancellation of the transaction as long as the order has not been sent by PERCKO UK LTD.

8. Defective products:

If the items you have ordered are defective or do not correspond to the description as given on the Website, please contact us as soon as possible at [email protected]. We thank you for returning defective products and we will proceed to replace them if these items are available or to refund them in full (including delivery costs) upon receipt of the returned products.

9. Your personal data:

The personal information you may provide to us via our site is collected and used in accordance with the terms of protection of personal data which are accessible on the footer of this website.

10. Responsibility:

If for any reason one of these Terms and Conditions sale should be declared inapplicable, this inapplicability shall not affect the application of the other provisions of the terms and conditions; the condition found to be inapplicable shall be replaced by the closest possible provision.

In its online sale process, the seller is under an obligation of means only; they are not liable for damages resulting from the use of the Internet such as data loss, intrusion, virus, loss of service or other involuntary problems.

The seller’s liability is limited to the purchase amount paid by the buyer. The seller cannot be held liable for stock shortages or delivery delays by suppliers.

Under no circumstances will PERCKO UK LTD be held responsible for any damages whatsoever, direct or indirect, caused to the user or a third party, due to a malfunction, failure, loss of earnings, loss of data, loss of profits, operating loss, loss of software, a deterioration or loss of material by the user or a third party.

The seller bears no responsibility for compensation for direct and indirect, material or immaterial damages arising from damage resulting from scenarios exhaustively described above. Nor does the seller bear responsibility for recovery, reproduction or repair costs resulting from such losses or damages.

The seller cannot be held responsible for any typing errors by the customer during the ordering which as consequence have resulted in errors or delays in delivery.

11. Retention of title clause:

Goods remain the property of PERCKO UK LTD until full payment of their cost.

12. Force majeure:

Where we are prevented from or delayed in carrying out obligations under these Terms & Conditions due to circumstances beyond our reasonable control including, without limitation, acts of God, governmental actions, war or national emergency, riot, civil commotion, fire, explosion, flood, inclement weather, epidemic, lock-outs, strikes or other labour disputes, or restraints or delays affecting carriers or an inability or delay in obtaining supplies of adequate or suitable materials then either our or the Seller's (as the case may be) performance of its obligations shall be postponed for the period of time that the circumstances continue.

13. Intellectual Property:

All elements of the site www.percko.com are and remain the intellectual and exclusive property of PERCKO UK LTD.

No person is authorised to reproduce, use, rebroadcast, or use for any reason whatsoever, even partially, elements of the PERCKO UK LTD website, software, graphics or sound.

Any simple or hypertext links are strictly forbidden without the express written consent of PERCKO UK LTD.

PERCKO UK LTD shall not be responsible if the content of the sites to which a referral with hypertext links is offered does not comply with the legal and regulatory provisions in force.

14. Archiving – Proof:

Computerised records stored in reasonably secure conditions shall be considered as proof of communications, orders and payments that have occurred between the parties.

Order forms, order confirmations and invoices are stored on a reliable and permanent media to provide an accurate and permanent copy.

The computerised records of the seller shall be considered by the parties as proof of communications, orders and payments that have occurred between the parties.

15. Confidentiality of financial information:

Our website does not keep the records of the payment details.

16. Dispute resolution:

These online sales Terms and Conditions are subject to English law.

For the resolution of all disputes relating to the sales contract, the parties may agree to submit to arbitration.

In the absence of amicable agreement, the customer can refer to the Consumer Ombudsman that is responsible for the retailer, i,e, the Association des Médiateurs Européens (AME CONSO), within a period of one year from the written claim addresses to the retailer.
